Position Summary & Responsibilities:
This Attorney II position is located in Topeka, at the Eisenhower State Office Building, and is within the Division of Chief Counsel.
This position handles routine to moderately complex administrative condemnation actions for right-of-way (ROW) acquisitions relating to highway construction projects. This position also advises various areas within KDOT on legal issues relating to property, corridor management, easement and access issues, and reviews and drafts a variety of contracts and real-estate conveyance documents. Additionally, serves as legal counsel regarding the Highway Beautification Act and related programs.
Job Responsibilities may include but are not limited to the following:
• Developing an understanding of the ROW required for construction projects and factors that might affect valuation. This may include reviewing construction plans and appraisals. Drafting or approving general pleadings, motions, orders, and notices for administrative condemnation actions, and representing KDOT at eminent domain court hearings and court appointed appraisers' hearings.
• Making recommendations to the Bureau of Right of Way and Chief Counsel on appeal of court appointed appraisers' awards.
• Securing expert witnesses and handling general discovery and depositions for appeals.
• Drafting or approving pleadings, motions, and orders for condemnation appeals, and representing KDOT before district (trial) courts on appeal.
• Learn the basics and stay informed of all areas of OCC (contracts, HR, litigation, property damage collections, KORA, beautification, etc.) to assist and provide legal representation when necessary.
• Counsel to the Office of Civil Rights (OCR) on issues relating to administration and enforcement of disadvantaged business statutes and regulations.

Qualifications:
Minimum Qualifications:
• Certificate of admission to the Bar of the Supreme Court of Kansas or temporary permit to practice law issued by the Supreme Court of Kansas at the time of hire.
• Valid Driver's License at time of appointment.
Preferred Qualifications:
• Education and/or experience in real estate law including, but not limited to, the Kansas Eminent Domain Procedures Act, land use laws, title and deed issues, recording requirements, real estate contracts, easements, and other interests in real estate.
• Experience in review and drafting of contracts and land conveyance/transaction documents.
Post-Offer/Pre-employment Requirements:
• Kansas Tax Clearance Certificate required in accordance with Executive Order 2004-03.
